I could be wrong, but I believe there is an SEC rule that says companies must impart material news as soon as its known. That is why companies warn early. To head off possible lawsuits. Once again the point here is what did they know and when did they know it? The whole situation is made worse because of the stock runup during this period of time when they MAY have known they would be missing by a significant amount.
