Greetings Greg, You may be wasting your sawbuck. The details of any agreement settling the case may not be included in the papers in the Clerk's Office. The papers in the Clerk's Office frequently do not contain the details of any settlement, they may only indicate that the case has been settled, dismissed, etc. Although unlikely, there could be some type of keep silent agreement within the settlement. Agreements not to discuss settlements are common in the tort field, but less common in this area. One area worth investigating is the lawyers. Their names and phone numbers should be readily obtainable from the Clerk's Office. Good luck sleuthing. Bob Cohen P.S. It would be interesting to know the details of the bankruptcy action. Were creditors given any rights to patents, proceeds of litigation, etc.? You would think if this was the case it would be mentioned in the 10K. I'd be wary of the PR man, who between the many analyists calls, offered the gem that there had been assignments. That means that CIST has given over or assigned their rights to something to some individual or organization. Could the assignments have involved patent rights or rights to proceeds of litigation? The problem I see with cist, which is common to many biotechs but especially to cist, is how do you compete with the insiders, especially as in the case with cist, when the company won't give out any information. |
