Far be it from me to dispute a lawyer's take on this whole argument. However, I do have a question--- is it really that the law's interpretation is 'changing' in that something which everyone did before will now be illegal-- or is it that nobody has done the sort of stuff that Microsoft has done to the extent that Microsoft has done it? Kind of like how the meaning of Constitutional amendments expand with the times?
