I don't know if MSFT really has much choice in taking it to the courts. They either take it to court or they accept the DOJ's directives. I also am not so sure that the outcome is certain in MSFT's favor. There is a lot of sentiment that MSFT is too large. Also MSFT has destroyed a lot of small companies in its march to the sea. This will not play well to a jury. We shall see.
