I believe the way all that I've heard has been worded that it's just the DOJ and the various state actions.

Why NSCP would be required to be delivered is a bit of a stretch imo as a remedy. But I would say that the contracts that they have signed with major oems and customers, probably stand on their own merit as far as evidence of coercion. I think that they are proceeding on this basis, using various subpoenaed documents to support MSFT's own intent in moving the way they have.
