Herm, I just looked thru my mail and see what I think you are talking about. IT IS NOT A LAWSUIT AGAINST VIVUS! It is a lawsuit against most market makers on the NASDAQ for fixing spreads since 1994. The suit claims the market makers kept the spread at 1/4's so they could rip off the small investor for 1/8's. The suit is for $1,027,000,000. How you ever got Vivus's name involved I know not but this would be a pretty wrong rumor to star spreading. Reread the booklet and tell if we are reading the same thing.
