Infoman,
The proceedings review and responsibility of inheritance is that of the person/s in question. It is not the requirement of another to take complete onus of what another may or may not have title too.
Further, it would not be the responsibility of SUF to to provide clarification to statements or issues that were omitted. And yes, I'm implying that transfer of the M1 was not contained within these documents.
As noted within the article of the heir " records of the deeds office were scrutinized and it APPEARED that the mineral rights sill vested in the estates of the original four mineral right holders".
Again, this continues to imply the uncertainty of who these beneficiaries may have been, if any.
As per your continuous statement, that such heirs were easily identifiable and could have been located with minimal effort, makes no sense to what was publicly written by that of the heir, nor to what has been factually documented.
Infoman, if this formality of ownership to the mineral rights was so obvious, why didn't De Beers proceed in contacting heirs, or did they
If you want to substantiate your comments as noted, specify the statement within the document which simplifies this key element of discussion. Transfer of the M1 mineral rights and its beneficiaries to be. "HEIRS" publicly noted.
You have not presented this publicly because it's not that cut and dry.
If it was so obvious De Beers would have contacted heirs, SUF would have proceeded through the same channel, after all prior to conducting any study of the property, mineral rights could have been bought at a minimal price. Does SUF retain Mineral rights to other surrounding properties that represent that of the Klipspriger, YES.
Did SUF concur in meeting legal proceeding in effort to acquire these mineral rights, YES, they have spoken directly with the owners of such rights.
Infoman, posting of the heir stated "Dr Jennings has repeatedly been quoted to say "they went through a process of silently and secretively acquiring the rights".
also
"The heirs and NGS are not the only people who have been bullied and threatened in relation to the Klipspriger project. Many others are contemplating legal action against SouthernEra"
Can you substantiate those comments, your previous statements in commenting that SUF did not proceed by the law in it's effort to obtain the mineral rights, have been contradicted with SA itself DME. Read what's on paper not that of what you want others to believe.
Protection under the constitution does not excuse ignorance.
De Beers mandate is obvious and such action is being viewed abroad, did these heirs make a mistake, you better belive it, your playing with a company that's far to big and if matters don't work out in there bust interest, good luck to NGS... |
