Oakley Prevails in Key Design Patent Infringement Case

IRVINE, Calif., Nov. 14 /PRNewswire/ -- Oakley, Inc. (NYSE:00) today reported
that the District Court of Paris rendered a favorable ruling in design patent
and trademark infringement cases brought by Oakley and its subsidiary Oakley
Europe against Killer Loop and Bausch & Lomb. The ruling represents significant
progress in Oakley's protection of its intellectual property rights.

The court ruled that the Eye Jacket(R) model is a registered design that is
new and distinctive and thus valid in France. In its judgment the court held
that the model Northside sold by Killer Loop and Bausch & Lomb was found to
infringe the registered design protecting Oakley's Eye Jacket. The court
awarded damages to Oakley from both Killer Loop and Bausch & Lomb and ordered
the cease of sale of all Northside products.

In addition, Oakley prevailed in a separate court ruling to invalidate Killer
Loop's French trademark registration number 632095, which featured a flattened
oval that was found to infringe on 0akley's elliptical icon design.
