It is a good point. My thinking had not reached that far.

Joe L's biggest block of shares are the 2.7 or 3.2 million [depending on which version you accept] shares held by Top-Net, Inc.; his son, Mario, is the President of Top-Net. But Top-Net has never filed a 13D registering themselves as a holder of more that 5% of Airstar.

For Joe L. to utilize those shares in the battle he is going to have to get the house in order with the SEC. That means coming clean about a lot of things that might not sit too well with the them. His being able to call the special shareholder meeting at all will require getting in compliance with the SEC.

Joe's post refers, in passing, to the SEC and is full of meaning.
