About half of the judges on the appeal court for patent cases are former patent lawyers. The appeal judges are three judge panels chosen at random. Usually each panel has at least one patent lawyer on it.

For what its worth, claim interpretation is a legal issue, meaning the appeal judges do not give any deference to the lower court decision. On the other hand, a well known patent appeal judge has said that your best strategy on appeal is to win at the trial court level.

Appelate practice is 90% brief writing. Holding anything back for the oral argument is foolhardy. I'll get back in at 1/4 if the appellate lawyers have adequate brief writing experience, especially writing before the CAFC (patent appeals court).
