See that word certainty there? Notice the use of the word conclusive? Shall I get those definitions too?
Monica could easily have been lying to Tripp, therfore, recordings of these conversations are, by definition, not proof.
As to whether they are evidence, well, I'll take sworn testimony more seriously anyday. So will a judge. So, if she lied in that testimony, they will have to prove it beyond a reasonable doubt.
But, you can say you have some evidence. However, there is stronger evidence that directly contradicts it.
