I am going under the assumption that MDIX has competent patent counsel and that together they know what they are doing regarding the patent application.

I have told more than a few clients that if I had a choice between:

A. holding my business hostage to the perceived need for a bullet-proof patent, or

B. getting on with business and gaining a years jump on the market all to myself

I'd take B any day of the week.

I also assume that any party interested in partnering with or acquiring MDIX will be concerned with what the patent is purported to protect and will be given access to the patent application and other materials so that their patent counsel can make their own analysis.
