Don't you see it as obvious that hte DOJ is fightig the war of NSCP in lieu of the American people. The average person does not have a problem with MSFT. Even if MSFT has acted unlawful, the proposed solutions are heavily weigthed in the favor of MSFT's main Internet competitor (who just happened to do some heavy duty Federal lobbying) instead of "budding entrepreneurs".
