Well actually the States are free to do what they like as long as they do not violate the Constitution, or abrogate powers allotted to the federal government under the Constitution. And I do not see how a ban on smoking violates the Constitution anymore than a ban on sterilizing the insane does. I suppose you could scrunch it into the due process clause but that would be as bad as the garbage the Warren court did imo.
