Alex, people who work in bars tend to be unqualified for jobs which require more skills. So there is a real question as to whether they are really giving free, uncompromised consent when they waive their rights to clean air, and whether they themselves smoke is irrelevant to that argument. They may be acting on short-term desperation, rather than weighing all the facts in a reasoned way. The state also has an interest in creating and maintaining reasonably healthy workplaces, in the interest of public health.

So while it may or may not be discriminatory to hire only smokers, I don't think it solves the larger problem of second hand smoke in the workplace.
