Actually, both Intel and Microsoft have done things that they ended up regretting in a legal way, at some point or another. The difference is that Intel is choosing to play nice with the government while Microsoft is playing rough. Intel, for example, recently lost a suit to another company (Integraph) that said Intel was trying to bully them into giving up some patent rights. In another case, I'm sure everyone here noticed Intel's purchase of Digital's Alpha production facilities. Well, part of the price was apparantly an Intel payoff to Digital after Digital found some proprietary Alpha ideas in Intel chips. Finally, Intel's decision to potentially license Slot 1 is almost certainly an attempt to show the FTC and DOJ how nice they can be to AMD and NSM.

By the way, in one of those weird ironies, Digital twisted a lot of business out of Microsoft when they noticed a suspicious abundance of VMS ideas in NT. The fact that the guy who headed up the VMS project for Digital later was head of NT development at Microsoft helped Digital put 2+2 together.

So it's pretty easy to see that both Intel and Microsoft are at least vulnerable to legal action, whether by the government or by other companies.
