1. It should be a co-operative system as opposed to an adversarial system designed to solve problems not prolong them.

We've already got this, It's called the legislative and executive branches of government.

2. ...arbitration

Sometimes there has to be a clear winner and loser, arbitration shouldn't be imposed as a rule instead of a option that both parties agree to.

3&4. complicated rules, self representation, manipulation

Well we all have the right to self-representation now, yeah the rules are complicated on balance this works to everyone's advantage. One man's manipulation is another man's great defense/offense. Look at how everyone associated with Clinton has tried to manipulate both law and the political system, and how they're getting peeled back by the judges overseeing the case. Ultimately the truth will will out (not that the truth always wins.

Now, if we could only figure out a way for all this convo to make us some money....
