Hello! Jack,

You mentioned that I should forget the lawsuit deal?

I imagine that the Conrail Management would enjoy seeing NYRR Management forget about the lawsuit!

In my view it remains one of the negotiating tools that NYRR has at it's disposal during these sensitive times for Conrail and it's potential merger partners!

Since I am not privy to any of the details surrounding any/all activities encompassing any potential benefits from any of the merger hearings --I am clinging on to the things thatI understand are known to me--via previous press releases and communication from NYRR Management!-And the one area that has remained consistent throughout is that the last time I checked with NYRR Management the Conrail lawsuit was still in process!

Jack, if you have heard otherwise then I'm sure many of us would like to hear what you have to say!

Please understand me, I feel that there are many variables that could bring significant benefit to NYRR and it's shareholders, but those potential variables are only speculation and opinion at this point in time!( At least to the best of my knowledge!)....

May I also recommend Jack that rather then attacking my ideas or opinions that you also consider adding your ideas and opinions to the bettorment and quality of this thread!

Best Regards,

Wayne J.
