Don,

We got a run in less than 3 days of trading from a trading low of 7 5/8 to a trading high of 14 1/4. Those with perfect timing could have captured an 89% return in a few days. Those who did not have perfect timing but had the smarts to load the boat under 8 and then sell at 13 1/4(it was stuck at this trading price for more than 1/2 the day) could have made a 70% return on their investment. The only reason the stock did not keep running is because the shorts had a lot to lose and decided to throw millions more into their position once the stock slowed down a bit. Did they short non-existent shares? We will find out soon enough but it is my belief that on that second day when Vivus share price was stuck at 13.25 that shares were being shorted that were not available and it is from this point and downward that I believe accounts for the 25% increase in the short interest on a stock that no one could find to borrow when they called up their brokers.
