For what it's worth... the latest from the Defendants' e-mailing list run by Oppedahl.
Recall that recently (May 22) the law firm of Graham & James had entered an appearance in the New York action on behalf of IGE/E-Data. Just two days before, Mr. Fink had send around a fax asking about counsel's convenient dates for a status conference with the Court in the New York action.
As of now, I have not heard of such an appearance having been filed by Graham & James in the Connecticut action.
There are now more developments.
1. A fax came in May 26 from Graham & James.

E-Data, formerly Interactive Gift Express, Inc. ("Plaintiff"), moves this court to extend the time to file its Motion for Reconsideration which would presently be due on June 1, 1998. Plaintiff requests that the time for filing a response be extended to June 11, 1998.
The extra time is needed because Plaintiff has recently appointed a new trial counsel, Graham & James who have filed a Notice of Appearance before this Court on Friday, May 22, 1998. Plaintiff's counsel requires time to review the record and to obtain the files which currently reside with Plaintiff's former counsel, David Fink, Esq.
Graham & James will be filing with this court a Substitute Power of Attorney, on behalf of Plaintiff, replacing Plaintiff's former counsel David Fink, Esq. with Graham & James LLP.

2. A fax came in May 28 from Graham & James informing us that the telephonic status conference in the New York action is now set for 5 PM EST on Wednesday, June 3. The fax also instructs all of the New York defendants to direct their correspondence henceforth to Graham & James rather than to Mr. Fink.
