It will be interesting seeing the request for reconsideration. Usually they fail, but it even if it fails we will be able to see the approach the new lawyers take. I hope they focus on one or two issues, and make arguments based on the text of the patent (and the file history). Personally, I'd focus on point of sale. The judge was wrong, but never really heard GIFT's side of the story. Several years ago I worked with one of the new lawyers on other patent cases, and I expect he will do a good job. GRC FTR long, but ready to sell on a run-up and rebuy on the down swing.
