They can share the info. now because most of the big money undoubtedly sold out during the run to 40. Also, until the NDA gets filed, there is always the possibility that the FDA will reject their application to file. Because of this possibility, their lawyers probably advised them to divulge info now in order to avoid another dozen or so lawsuits stemming from this last run up.
