Interesting point made by my bankruptcy atty friend.
I didn't realize this and so probably many of you don't either. A Federal Bankruptcy Judge has the right to look over cases from which judgements have been passed down that are pertinent to a case in their court, and determine if the judgement and finding in the case are fair and equitable. They have the right to overturn not only the judgement amount but also the verdict itself.
I have no knowledge of this occurring with the FSCX situation. But it would surprise me if Madsen's atty's hadn't already thought of this as a possible strategy in this filing. Davidson is clearly on the defensive now along with FSCX. I'm not sure what's going on but I believe with the legal fees FSCX has been paying, we've at least got decent counsel for this situation.
