[Judge moves Ameritech, Qwest case to FCC]

(AIT is still offering QWST service to its customers, unlike USW. i talked with a QWST representative today and she said the AIT offering wasn't generating anywhere near the level of customers they were seeing in USW territory. -- mark)

NEW YORK, June 9 (Reuters) - A federal judge in Chicago has referred a challenge to a marketing alliance between Ameritech Corp. and Qwest Communications International Inc. to the U.S. Federal Communications Commission, AT&T Corp. said Tuesday.

AT&T, MCI Communications Corp. and others sued Ameritech in U.S. District Court in Chicago contending the pact violates the U.S. Telecommunications Act's restriction against a local phone operator offering long-distance service while its monopoly remains intact.

Last week, a federal judge in Seattle asked the FCC to rule on a similar pact between Qwest and U S West Communications Group.

AT&T said in a statement it appears the FCC is best suited to determine the legality of such marketing arrangements.

"In accordance with the Chicago court's ruling, we plan to file our request with the FCC for a preliminary injunction asking them to halt Ameritech's marketing of Qwest long distance service until the matter of legality is resolved," the long-distance provider said.

Diane Reberger, spokeswoman for Denver-based Qwest, said the company was still reviewing the judge's decision and would not have an immediate comment.

Ameritech officials were not immediately available to comment.
