What are the appropriate channels for criticising the TSE in general and Mr. Fleming in particular?
Apparently Mr. Fleming and the TSE prefer a written letter, which they can ignore and do nothing about. At least that way, no one will know what the TSE is doing wrong, and the "status quo" can continue. Normal channels of reasoning and suggestion have had no effect on the TSE.
I believe Mr. Fleming could use some of his money and buy a dictionary. If he were to look up the word libel, he would see quite clearly that libel is qualified as "any false and insulting statement". In other words, it is a "written lie that is defamatory in nature." Mr. Fleming nor his lawyer could provide an example of libel, because there was never a libelous comment made. You can't sue someone, Mr. Fleming, if you are insulted or feel defamed by the truth!!!
At least if he is going to try and defend himself, he had better understand what he was accusing Porter of. He apparently does not understand what libel is, and it only reflects poorly on him when he can not provide examples. There is no question in my mind that the TSE was effectively bullying, posturing, threatening without cause, and currently trying to cover up their own unprofessional and basically disgusting behaviour. If public opinion is against them, it is a "cause and effect" relationship where years of ignoring investor concerns has finally begun to catch up to them. Mr. Fleming can not blame the "effect" because his inaction and lack of concern for investors "caused" this series of events to happen.
Mr. Fleming's attempts to silence the innocent Porter Davis, has only lead to a "deafening roar" of disapproval. He can plug his ears, and continue to ignore the situation, but he will not be able to do it indefinitely. |
