If his shares were purchased before IBM sought the acquisition, then no problem. There's always some kind of background noise about a buyout in NSCP, so it would be hard to nail him on inside information. The media makes it sound like he bought the shares yesterday, which is absolutely ridiculous. My experience has been that takeover rumors are started so that a big player can unload a position. This can make for a good short, especially if it gets on CNBC.
