On the other hand..............(and, I like your upside postulate), if the earnings are neutural to less, in order to protect the poison pill, you have to move the announcement away from the pill date. Otherwise, by case law, evidence exists that you put in the pill to discourage offers (thus harming the shareholders, and making the pill reversible).

I think the Street will read the pill as way negative for the earnings announcement, and sell off today. Let us see.

And, since I have posted both ways within the last 24 hours, it seems clear to me that I haven't a clue. I am going to sell one-half my 52,350 shares today, at a small gain.
