There are multiple arguements that can be made on the matter of damages in regard to supervisory goodwill. The amount of goodwill in question is 325MM at Carteret. If one places an interest rate factor on that amount say 7.5% and compounds the amount from December 1992 until 1999 you double the amount of the claim. 650MM divided by 44MM shares outstanding less taxes you have an $8 to $10 number. ABCP does have a NOL to offset taxes. The other arguement that could be made is what is a 100% ownership interest in a $7.5 Billion thrift in New Jersey worth? If that is the tact ABCP plans to take than expect them to ask for a number well in excess of $1.5 Billion. This is what creates potentially dramatic upside in the stock.
