You are incorrect

A market maker is unlike the public.

Firstly, the $5 rule is merely for purposes of marginable securities and this is only where the public is concerned.

Second, Bulletin Board stocks are non marginable and can only be shorted by the investing public through Canada, although its not 100% kosher.

A market maker can short any Bulletin Board stock at will. If a market maker could not short a stock then it would be possible for there to be no offer which is obviously unreasonable.

The only thing that a market maker cannot do is short an IPO.
The public is the only one that needs the ability to borrow the stock.
