You hit the nail on the head that it's all up to the jury on this one. I believe that ABX has a solid defence in the fact that they signed a "Letter of Confidentiality" when the D.D. was to start. This should hold up in court. The real company to burn will be SNC Lavalin and the procedures that were used. Look for countersuits to come out from this. This thing will drag on for years to come.
