I'm not a lawyer but I think Starr was really stretching on this one. The only argument which could be made specifically in Foster's case (and one I thought the Supreme Court would allow) was the fact that had Foster been alive, Starr could subpoena him to testify before the Grand Jury. The notes were the next best think in this circumstance.
