Janybird,

Deception and hype from you again!

From the SPRX 10Q for 1Q98 (portions selectively quoted by Jany):

>> To date, the Company's manufacturing activities have consisted only of building certain prototype devices and pre-release versions of its BiliCheck and BiliCal products.
If the Company successfully develops its diabetes screening and infant jaundice products and, together with Roche Diagnostics BMC and Respironics, obtains FDA clearance and other regulatory approvals to market these products, the Company will undertake to manufacture these products in significant volumes.
The Company has no experience manufacturing such products in the volumes that would be necessary for the Company to achieve significant commercial sales...... <<

You use the company's 10Q and present it in such a fashion as to make the reader believe that this is the present fact. Why didn't you include SPRX's news release of 4/6/98? You know the one titled

"SpectRx Announces First Commercial Shipment of the BiliCheck Non-Invasive Bilirubin Analyzer to International Markets"

Do you deliberately intend to mislead? Many of us out here are not so stupid and are speaking out here to protect those who would fall for your hype, myself almost included!

The real facts are that SPRX did not manufacture products in the first quarter of this year and the 10Q reflects that. But SPRX is shipping now and no one will know the exact volume of sales (except for insiders) until the next 10Q is released.

Also, the rest of what you quoted is legal mumbo jumbo that nearly all reputable companies include in their 10Q to keep from getting intimate with the likes of Milberg Weiss. Other companies less scrupulous just put hype in their reports as they will ultimately get sued anyway, so excuse me if CCSI's 10Q's are a bit more optimistic in their forward looking statement.

So come on Jany, be bold, and either present all of the facts or speak for yourself instead and continue presenting company statements out of context. If you can't present all the facts, then what you present is no better than your own opinion, so, go ahead, quote yourself (I'm sure you'll call those facts) and state that SPRX is not shipping production units today! Next month's 10Q will prove you wrong and all will see you for what you are!
