If we were willing to be really charitable we could give them the benefit of doubt by supposing that in the press release they were being brief and left out something like the following qualification which would have cleared things up:

<<Its terms prohibit holders from engaging in short sales of the Company's common stock prior to the registration statement being deemed effective.>>
