for putting this on the thread. Note the observation by the author (an intellectual property attorney at an exceptional firm) that the damages determination by the Fonar court was done "...all following the reasoning in Rite-Hite." If the appellate court agrees that the decision properly followed Rite-Hite and other precedents, it will affirm the decision. Only if the appellate court determines that error
was committed in the trial court will it remand (send back for modification) or reverse (undo the judgment entirely). Complete reversal is in my opinion a long, long shot. Remand unfavorable to Fonar, or remand favorable to Fonar (i.e. damages to be awarded for inducement, the 13.6 million) are both in my view unlikely. Affirmance appears to be the likely outcome. Hey, just my opinion, and I'm long on Fonar.
I'd like to hear from an IP attorney if any are lurking quietly out there.
