Gentlemen,

This whole argument is bunk other than its entertainment value.

All the marking does is guarantee the MINIMUM set od specs the devices must meet.

As an example folks used to buy Mil Spec Devices and Commercial Grade devices. The only difference is the extended testing and guarantees the vendor provides.

I am sure that the 400Mhz devices will have been tested at speed and the 350Mhz device will at least have been tested to guarantee 350Mhz performance. As such the devices meet the IC specs as sold.

The difference is not neccassarily in the chip at all but in the testing and the performance GUARANTEE that stands behind the devices.
