Yield-Up Infringement Action Reopened

CFM's Motion for Reargument Granted


WEST CHESTER, Pa.--(BUSINESS WIRE)--July 6, 1998--CFM Technologies Inc. (NASDAQ:CFMT - news) announced today that the United States District Court for the District of Delaware has granted CFM's motion for reargument on YieldUp International Inc.'s motion for summary judgment that YieldUp has not infringed U.S. patent 4,911,761, owned by CFMT Inc. and licensed by CFM Technologies. The ruling gives CFM the opportunity to submit additional evidence to rebut YieldUp's contention that its semiconductor wafer processing system does not infringe the '761 patent.

Roger Carolin, CFM President and Chief Executive Officer, commented, ''We appreciate the opportunity to clarify a genuine issue of material fact related to the operation of the YieldUp equipment. To put it simply, we do not believe that blowing hot nitrogen over a wafer dried with our IPA drying technology eliminates the infringement that took place during the drying process. We believe that YieldUp's Marangoni process is essentially identical to the STEAG process that this Court found to infringe our '761 patent, leading to the Court permanently enjoining STEAG from importing, making, using, offering for sale or selling the infringing product in the United States.''
