He specifically gave investment advice: But after the earnings date this stock will start a long slow slide (with ocassional spikes here and there).
If the SEC wants him they can now get him for, would you believe it mail-fraud. Using the mail and phone system interstate illegally; he is not licensed to do so. If some-one sells their MSFT shares based on his advice and the shares go up they can sue him. He did not qualify his opinion, he expressed his prediction as a fact.
