Wow, yes! I guess a judge will be hearing some comments as he makes his decisions. If I were the judge, I would be concerned about the balance of power in the agreement talks. Responsibility to answer questions, I suppose, will belong to Jack. Any WOTD papers of course, the judge may only be interested in their legal appearance not the consequence of them? -since it is a case within CVIA, and not against WOTD? "I don't know." someone may want to correct me here, because I may not know what I'm talking about.
If I were a judge, I might think, yes, this Jack is all alone. As a judge, not a business man, I would think of how that situation might best be corrected.
In not desiring to jeopardize the success of the talks himself, for that is not his job, the judge may think Jack should not be removed, as only he knows what is going on, and Jack is the only link to any owners of CVIA (the shareholders), and to the talks as well. Loss of Jacks knowledge by him being excluded might not be in the best interest of anyone.
I would also consider the legal rights of an investor, or stockholder; how those rights are limited because investors trade in and out of a stock freely for the purpose of gain.
Knowing that insider trading (for gain) can be different, and I would be suspicious for the Reg. S and behavior related to that; And be wondering where the money ultimately is to be, or has been used, and by whom. However, they have had ample time to make all this appear legal. So what the judge sees/hears will be quite cloudy (when will CVIA be paid back?), or misleading, (Was This money was squandered long ago, and the "loan" is paper created to cover the fact).
Those were just "what ifs", but I am amused. What company, after the merger would be compelled to pay itself back?? That paper sure is a pain the butt for present day stockholders though. People "closer" to the money made sure of that.
I would love to read the words passed around in the courtroom, KAA! Is that possible? On a thread called "GIFT, (the Internet patent)", the source to conversation in the court was provided, (a link to another web site) Might we be able to read an account of the courtroom questions and answers in the same way? That would be a blast for getting a down home feel feel for the situation rather than a simple one paragraph piece of news!
I am tired of vague news; -that now CVIA can't even afford to broadcast. This would be words from Jack, the lawyer, and the judge. Any where from Simulating information to paid for entertainment, It would give the shareholder a chance to use his mind on some present day issues. For quite a while the blinders have been on for "pin the tail on the donkey" -present day thread efforts have been trying to end.
Congratulations. $5000 = 10 news broadcasts from what I understand. I wonder how many pages of reading material might be available soon from the legal effort that was piloted on this thread? It could be a nice bonus!
And After all, isn't what goes on in most courtrooms open to the public. And Is any reliable person going to drop into the courtroom to make note of the sweat or emotion that can't be noticed in the written words alone?
