An application brought in the Provincial Court of Warsaw, Poland, by Thermo Tech Waste Systems against the company's Polish subsidiary, International Eco-Waste Systems, has been summarily rejected by the Polish court.
In this application, Thermo Tech sought unsuccessfully to restrain the activities of International Eco-Waste Systems and to compel it to deliver up confidential information in its possession. Judge Miskiewicz found that there was no basis before the court to support the application and it was therefore rejected.
As the company advised in its earlier news release in Stockwatch on May 28, 1998, the claims of Thermo Tech, including those advanced in the Polish proceedings, are completely without merit and represent another attempt to divert attention from the real issue, which is the continued and blatant failure of Thermo Tech to comply with the order of the Honourable Mr. Justice Cohen of Jan. 20, 1998, requiring delivery up of all standard certified engineering specifications, including drawings, regarding thermophilic plants to the company.
The company awaits the decision of the Honourable Mr. Justice Cohen on the contempt motion brought against Thermo Tech in the Supreme Court of British Columbia and will issue a news release upon receipt of that decision and upon all other developments in the proceedings.
