Philip - I think that's a good explanation. I have been wondering exactly how ERICY and QCOM would come to terms in regard to CDMA. ERICY has an enormous installed base. QCOM would be fighting a very tough uphill battle to convert all of that base to CDMA. ERICY, on the other hand, could not continue to ignore CDMA.

I am sure ERICY will want the best possible terms in any license deal so the lawsuit could be an attempt to bully QCOM into more desirable terms.

The situation sounds kind of bazaar though, filing suit and then saying "oops...."

It will really be interesting to see how this one plays out.
