Spoke with IR today (NF).

Expect only one milestone of $2,000,000.00 this Q. Vivus does not expect all 4 European countries to all grant approval until the end of the year. Vivus only gets payment after all four (Germany, Italy, Spain, France) approve.

It was absolutely impossible to squeeze any new info out of her about the domestic partnership or a potential buy-out. She seemed VERY tight lipped about discussing these matters.

As far as the partnership goes she said the same stuff they already mentioned ie that Vivus would like to agree on a domestic partnership by years end. In the mean time there will be no salesforce calling on PCP's. We can only hope (for the sake of domestic scripts) that Vivus cuts a deal sooner rather than later. I guess negotiating a favorable unit price or sales condition is the main goal.

I was told that Vivus would favor a partnership over a buy out.

I was told that the board would have to vote and approve any buy out.

At the snails pace that Vivus management tends to move, I am not holding my breath for any quick announcements but you never know.

In the mean time I expect the stock price to move slowly upwards based on a slow increase of domestic scripts. The only thing other than a partnership/buy out that will move us in a rapid North direction would by an upgrade (First Boston?) or news pertaining to Viagra's safety problems or Wilson's resignation--again I'm not holding my breath on any of these things happening in the short term.
