the pleading
will never survive a motion to dismiss
and
to say it's frivolous is an understatement,
i would be surprised if sanctions don't become
the central issue because the substantive " issues"
do not appear capable of being joined...

if we are to take this plaintiff at his word...
"He said he was suing Pfizer because he wanted the drug to be taken off the market.
then an equitable remedy [an injunction]
would be the appropriate relief sought,
and not a claim for damages
[compensatory or punitive]
in a well pled suit, of course, all of these would be claimed,
but by definition, this may not be characterized as a well pled suit.
if one perceives a public health threat ,
would they not file an order to show cause (assuming they established
standing)why such an injunction should not be granted against both the FDA and PFE.

the bottom line:
we all know the motive here
and
it does not arise from a sense of civic duty.

finally,
