Virtually every ADOT press release contains similar wording in regards to having the first right of refusal. If it weren't true then Biomoda would have put a stop to it by now. ADOT only owns Biomoda stock, and they have the first right of refusal. When Biomoda needs to manufacture/distribute scanning test devices in mass, and if ADOT is capable of doing the task and willing they get first shot at the contract (ADOT has to say No first before going to someone else). Biomoda doesn't currently have a need to manufacture/distribute just yet, so the only thing at present in common is that ADOT owns xx% of Biomoda.

You could ask 2 people if they know each other, and it is possible for 1 to say 'Yes' and the other to say 'No' based upon each person's criteria that determines if they know each other.

Ex (slight exaggeration, but hopefully my point is clear):

Person 1: Yes I know Person 2. We did a business deal together. Highly respected person, some of my friends know him. Company that I am a CEO of owns xx% of the company and has first right of refusal to manufacture widgets that Person 2 is a CEO of.

Person 2: No I don't really know Person 1. Don't know what his hobbies/interests are.
