Agreed. Between the ruling against the EPA and the ruling against the class action suits should give light the fire under the tobacco companies this week. It seems like Mighty MO and friends are in the saddle on the legal front. Now we must see if they can get a better deal on a settlement, or whether they should completely walk away. I am not sure what the best solution is because not even the current talks with the AGs will grant the industry immunity from future class actions. That, IMO, is the biggest uncertainty. Settling the current cases is the easy pary. It's the future litigation concerns that keep tobacco in the doghouse. I'm waiting for Congress to wake up and learn that the law is on tobacco's side. These tobacco cases are costing taxpayers millions of dollars, and all the governments can do is lose.
