I would hope that in the future that management puts up for a shareholder vote those matters which gravely affect the market value of our stock, after all who are the owners of the company?
Management has a duty under Rule X10b5 of the Securities and Exchange Commission rules to deal fairly with the shareholders of the company. The fact that the Castle Creek deal was done without shareholder approval does not bode well for the wisdom of management.
I would fault the CFO but the bottom line is that Dr. Aviv shares responsibility for that fiasco. It is clear that as we get near Phase 3 trials on Hu-211 to prevent a blunder like the Castle Creek deal from happening again.
Counting Mr. Rosen, this thread holds at least 10% of the common stock of the company and maybe more if you count anyone who has posted the site. Management, who I know reads this site daily, listen in. Your owners are not happy with Castle Creek.
