Thanks for the response, I really didn't have to pull the trigger, I just felt it was a good opportunity to use a tax law to my advantage, I did state that I will keep a close eye on it, but I feel thirty days under the current situations isn't that big of a gamble, I admit I could be wrong, but tried to explain why I felt the way I did.

About the options, I am still an infant trader, (less than a year) still learning. I just recently got a minimal understanding of options and huge excitement about them. I am in the process of getting set up to do just that, but my brokerage wants me to sign some additional papers first, I think they merely state that I being of sound mind do hereby acknowledge that I can loss my AS* in options before they will let me trade them. I'm really excited about covered calls & puts I know there must be something I'm missing because the way I see it, it is a WIN WIN situation. But that is a interesting question I will pose to my tax man about trading the options during the wash sale period.
