In the ongoing controversy over whether Neutral Posture Ergonomics, Inc. ("NPE") of College Station, Texas, has legal title to U.S. Patent no. 4,552,404, covering an ergonomically-designed office chair, the 85th Judicial District Court of Brazos County DELIVERED VERY BAD NEWS to NPE on Thursday. The Court handed down its ruling on a motion for summary judgment, holding that Dr. Congleton's earlier assignment to NPE of the '404 patent WAS NOT LAWFUL. Bodybilt, Inc. ("Bodybilt") has now been VINDICATED BY THE COURT upholding Bodybilt's long-held position. Thus, Dr. Congleton's 1991 agreement to not contest Bodybilt's right to make its ergonomic office chairs after going public HAS BEEN RESTORED. NPE's ability to interfere with Bodybilt's production using the Congleton patent has been stripped from them by the Brazos County court.
