Enforcement Division



The Enforcement Division is responsible for the enforcement of all the laws and regulations administered by
the Department of Corporations. These laws include the Corporate Securities Law, Franchise Investment
Law, California Commodity Law, Escrow Law, Health Care Service Plan Law, California Finance
Lenders Law, and the California Residential Mortgage Lending Law.

The Enforcement Division brings hundreds of administrative and civil actions each year. These actions
result in public records of actions against hundreds of violators of the laws that are available for review at
the Department's offices. To determine if there is a public record against any individual you are or may be

The Enforcement Division may investigate any violations of the laws and has the ability to issue subpoenas,
take testimony, and execute search warrants.

The Enforcement Division's powers include the issuance of administrative orders to stop violations of the
laws, to deny, censure suspend, revoke or take possession of licensees, and to censure, suspend or bar
individuals from participating in an industry.

The Enforcement Division may bring civil injunctive actions in the name of the People of the State of
California to enjoin violations of the laws, to appoint receivers over companies and to obtain equitable
remedies including rescission, restitution and penalties against the violators.

The Enforcement Division may also refer violations of laws to the appropriate District Attorney for criminal
prosecutions and assist in the investigation and prosecution by the District Attorney.

The Enforcement Division receives thousands of complaints a year and makes every effort to investigate,
make a record or refer a complaint to another agency if the matter is not within the Department's
