****Mr. Rogu's Case Examined*******
Dear Everyone, here is what I've got on Mr. George Rogu's situation. I hope it is fair and unbiased. For those of you who are baffled by the recent "dealer" negatives, I hope this can shed some light on the situation. Please keep in mind this research is not quite complete. I still need alot of documentations from Mr. Rogu and his friends to get an accurate picture. But in George's behest, he wants me to post what I know and what I think asap. So here it is:
So far, Geroge Rogu has given me enough info for me to believe 1) he was a dealer of CCI 2)Darell Piercy owes him $7,500 3) he has filed complaints with Irvine DA and BBB.
George has claimed (still waiting for documents from him): 1) there are about 15 dealers that suffer the same fate as he. 2) he couldn't successfully sue Mr. Piercy because a) he's got connections in Irvine b) he hides his assets. 3) there are ongoing lawsuits against Darrell Piercy (I'm not sure, I think he said two judgements against DP too. -- waiting for document)
What George could not confirm: 1) how many dealers did CCI have? 2) how many customers did CCI have? (George believes 1.5 million is realistic) 3) how many cds were actually sold? How many disgruntle customers are there? 4) George mentioned alot of customers who did not get cds through personal experience. He did not mention any lawsuits by the customers, yet.
Other relevant:
1) George has send me a copy of letter from Mr. Gordon to him stating that TSIG is not liable for the agreements between Darrell Piercy and former dealers. 2) George has tried to bring complaints against Darrell Piercy and the situation is moving very slowly. 3) George feels that he and his dealer friends are cheated by Darrell Piercy because after he sold the MusicCards to his customers, his customers could not get cds from CCI. 4) Although George stated that Piercy is a fraud, he did contribute to CCI of Nevada's problems to its inability to handle orders. 5) George stated that he has no interest in TSIG. The reason he is doing this is to "rock the boat" hard enough so TSIG would have to deal with the former dealers. 6) George also said that he believes Mr. Gordon have tremendous influence on Darrell Piercy. So by "rocking the boat", he may force Gordon to step in and make the responsible party, Mr. Piercy, face up to this problem. 7) George stated that he means no harm to TSIG. He said that he is good with websites and think the TSIG's CCI is "one of the best (he's) ever seen".
My assessment of the situation so far:
1) I find Mr. Rogu a earnest person, who has an actual grieve with Mr. Darrel Piercy. 2) I believe there are other dealers who may suffer the same fate as he. (still waiting for documentations: George showed me his invoices, a promissory note signed by Darrell Piercy for $7,500, complaints to BBB and DA's office -- I'm waiting for the same documents from other dealers). 3) We don't know the exact number of dealers CCI had: Piercy mentioned +300, Mr. Gordon mentioned ~500. And we have an idea of the number of disgruntled dealers: George alleged that about 15 dealers he knows had problems getting their money back from Piercy. Mr. Gordon stated today there are about 8 of them. 4) We don't know the legal basis of Mr. Rogus's claim. (I was going to wait for the dealer agreement he's going to send to me. But he insists that I clear his name tonight and post this ASAP.) In other words, we don't know whether they have a legal claim against Darrel Piercy. We need to look at the contract. My intuition tells me that they should. But we are talking about a legal contract. They may not be entitled to a refund (according to the contract). There may be some contingency clauses. Maybe the dealers failed to make good on their part of the agreement. We don't know. We need to see the dealer's agreement. 5) I feel that Mr. Rogu did get shafted. Legal claims notwithstand, Darrell Piercy signed a Promissory Note for the amount he owed Mr. Rogu. I do feel Mr. Piercy to be a shady character. Furthermore, I feel that dealers and customer dissatisfaction and complaints (if true: so far let's assume it is) is a public relations problem for TSIG, especially it retained all the lexicons of the former CCI: CompactConnections and MusicCards. It will need to be addressed. 6) That said. It is my suspicion that the former CCI's main problem, which may be the cause of dealers' grieves (assumption still -- but definitely George's) is its inability to handle the load. I think that CCI did not expect to do so well. Whatever the reason they couldn't deliver the cds (assumption still). Then all the customers go and complaint to the dealers and want their money back. I suspect the dealers refunded the money to the customers, and therefore were left holding the cards. In light of this, TSIG's licensing agreement with CCI makes a lot of sense to me. TSIG have the ability to market and take orders and execute the orders. It can take internet orders and phone orders thus tapping into a lucrative virgin market : those that are afraid to give out credit card info through the net. With TSIG, the former problem that plague CCI should be no more.
7) I feel that TSIG and Mr. Gordon is in earnest with the new CCI venture. Their careful public relations strategy and the excellence of the website speak volumes. Their website-building partner's credential and technical excellence, Valley Media, is another confidence booster. I still believe that the website will open to a lot of fanfare.
