Once the Ch11 was applied for any chance of Canadian bankruptcy protection was lost. Its one or the other, Ch11 being the easier of the two to recover from. Eatons is one of the few I can recall that survived the Canadian courts where as CH11 has a surprising amount of successful recoveries.
